Our Experience

Maddox Hargett & Caruso, P.C., a National law firm with offices in Indianapolis, New York City and Cleveland, has led the charge to hold companies accountable for their products and services. We have been successfully bringing actions against corporations since 1991.

Current Consumer Cases

The firm is currently serving as putative Class Counsel in numerous pending class actions throughout the country, including the following:

  • Mack v. HHGregg, Inc. and Gregg Appliances, Inc. d/b/a HHGregg (Case No.: 1:08-cv-664 S.D. Ind.) Counsel in a purported multi-state class action filed on behalf of purchasers of dryer installations from HHGregg.

  • Moxley v. HHGregg, Inc. and Gregg Appliances, Inc. d/b/a HHGregg (Case No.: 1:09-cv-00581-SAS-TSH) Counsel in a purported state class action filed on behalf of purchasers of dryer installations from HHGregg.

  • Finnell v. HHGregg, Inc. and Gregg Appliances, Inc. d/b/a HHGregg (Case No.: 1:10-cv-00182) Counsel in a purported state class action filed on behalf of purchasers of dryer installations from HHGregg.

  • Balkema v. Wachovia Securities, (Case No. 3:11-CV-00412-SC N.D. Cal.) Counsel in a purported nationwide class action filed on behalf of Wachovia accountholders who did not receive notice of a class action settlement.

  • Baba v. Hewlett Packard, (Case No. C-09-5946, N.D. Cal.) Counsel in a purported nationwide class action filed on behalf of purchasers of HP's Pavilion TX 2000 and TX 2500 series notebook computers.

  • Eliason v. Gentek Building Products, (Case No. 1:10-cv-02093, N.D. Ohio) Counsel in a purported nationwide class action filed on behalf of purchasers of defective aluminum and steel siding.

  • Kruszka v. Toyota Motor Corp., et. al., (Case No. 2:11-cv-01578, C.D. Cal.) Counsel in a purported nationwide class action filed on behalf of purchasers of Lexus automobiles with defective paint.

Class actions where attorneys in the firm have successfully served as Class Counsel include:

  • Martino, et al. v. Motorola, Inc., (Case No. 03-CIV-1562 Medina County Common Pleas Court, Ohio, 2004) Served as Class Counsel for a nationwide class of consumers. The nationwide settlement included cash reimbursement to Class Members for out of pocket damages.

  • Johnston v. Thomson Consumer Electronics, (Case No. 29C01-9812-CP-995 Hamilton Circuit Court, Indiana) Served as Class Counsel for a nationwide class of consumers. The nationwide settlement included reimbursement to consumers for out of pocket damages.

  • Gomez v. Towne Bancorp, Inc., (Case No. 3:98cv7436, United States District Court for the Northern District of Ohio) Served as Class Counsel for a group of investors. The settlement included a return of funds paid by the investors to an escrow agent for stock subscriptions.

  • Shaver v. Standard Oil Co., (Case No. 46317, Huron County, Ohio) Served as class counsel to a group of former Sohio independent dealers alleging antitrust violations. The settlement included compensation to the dealers for overcharges paid by them for Sohio branded products.

  • Glatz v. Beaman, (Case No. 46317, 92-CV-058, Erie County, Ohio) Served as class counsel to a group of investors who purchased unregistered securities. The settlement, with over 60 individual defendants, included compensation for the amount paid for the securities.

  • Wiatrowski v. Sears, Roebuck & Co et al., (Case No. 1:06-CV-00637 N.D. Ohio) Counsel in nationwide class in which class members recovered the cost of repair to defective appliances.

  • Health Science Products LLC. v. Sage Software SB, Inc., (Case No. 1:05-CV 03329 N.D. Ga.) Counsel in purported nationwide class action alleging defective software.

  • Jenkins v. Hyundai Motor Finance Company, (Case No. 02:04-CV-720, S.D. Ohio) Served as class counsel to a group of Ohio residents who did not receive the post-repossession notice mandated by the UCC.

  • Goldstein v. The Home Depot U.S.A., Inc. (Case No.: 1:08-CV-01825 N.D. GA) Counsel in a purported nationwide class action filed on behalf of purchasers of dryer installations from Home Depot.

  • Kaiser-Flores v. Lowe's Home Centers, Inc. (Case No.: 5:08-CV-45 W.D. N.C.) Counsel in a purported nationwide multi-state class action filed on behalf of purchasers of dryer installations from Lowe's.

  • Eckstein v. Lowe's Home Centers, Inc. (Case No.: .: 5:09-cv-00095-RLV-DCK W.D. N.C.) Counsel in a purported state class action filed on behalf of purchasers of dryer installations from Lowe's.

  • Frankle v. Best Buy Stores, L.P., (Case No. 08-5501, D. Minnesota). Counsel in a purported nationwide multi-state class action filed on behalf of purchasers of dryer installations from Best Buy.

  • Woods v. Best Buy Stores, L.P., (Case No. .: 2:09-cv-00180-TLS-PRC N.D. Ind.). Counsel in a purported state class action filed on behalf of purchasers of dryer installations from Best Buy.

  • Schweinfurth, et al. v. Motorola, Inc., (Case No. .: 1:05-CV-0024 N.D. Ohio). Counsel in purported nationwide class action alleging defective cellular phones.

  • Sanbrook v. Office Depot (Case No. 5:07-cv-05938-PVT, N.D. Ca.) Counsel in a class action filed on behalf of purchasers of Office Depot's “Performance Protection Plan”.

Consumer Case Victories

Defective Software. In a case involving allegedly defective software, we obtained a recovery for a nationwide class of consumers. The settlement included cash payments to those who had purchased the software.

Auto Finance Company. In a case involving the failure of an auto finance company to provide proper post-repossession notice, we obtained a settlement on behalf of a class of Ohio consumers that provided for the canceling of any claimed deficiency balance and restoration of the consumers' credit history.

Defective Clothes Dryer. In a case involving allegedly defective clothing dryers, we obtained a settlement on behalf of a nationwide class of consumers that provided for a full refund of repair costs.

Defective Cellular Phones. In a case involving allegedly defective cellular phones, we served as Class Counsel for a nationwide class of consumers. The nationwide settlement included cash reimbursement to Class Members for out of pocket damages.

Defective Televisions. In a case involving allegedly defective television sets, we served as Class Counsel for a nationwide class of consumers. The nationwide settlement included reimbursement to consumers for out of pocket damages.
