California Car Lemon Law

It's not the fruit causing financial headaches for consumers in California. It's an automobile - and various manufacturers taking advantage of consumers by fraudulently charging those brave enough to exercise their Lemon Law rights for cosmetic damages at the time of buy back.

More and more vehicle's owners are finding themselves frustrated over the treatment they're receiving from Automobile manufacturers in California. California's Lemon Law, the Song-Beverly Consumer Warranty Act, provides relief to consumers who purchase or lease problematic vehicles.

Specifically, the California Lemon Law covers new and used vehicles sold or leased in California that come with a new vehicle warranty or purchased outside of California if you are an active member of the military who is stationed in California. If the manufacturer or dealer can't repair a serious warranty defect in your vehicle after a “reasonable” number of repair attempts, the manufacturer must either replace the vehicle or refund its purchase price.

In a growing number of complaints from consumers, however, manufacturers are refusing to comply with their legal responsibilities. Instead, they say “cosmetic” or minor damage beyond “normal” wear and tear has occurred to the automobile and, in turn, charging car owners for a dent or scratch. These charges can run from a few hundred dollars into the thousands of dollars. They are unlawful, potentially fraudulent charges.
